We paid the immo when we bought our house. Whether the seller pays the immo or not is surely stipulated in that contract that you speak of. You were invoiced by the immo and paid them directly? - or were the the immo fees included in the money you sent to the seller's notaire?

It can be done both ways, we have had an invoice from an agent for his commission on the day of sale.

Assuming you were the buyer in that instance, that surprises me because the seller has a legally binding contract (mandat) with the immo...and with that comes a legal obligation to pay his fees....but hey, ho...we are in France.

Assuming you were the buyer in that instance, that surprises me because the seller has a legally binding contract (mandat) with the immo...and with that comes a legal obligation to pay his fees....but hey, ho...we are in France.  The last one at Brillac was a repossession, the agent invoiced us for the agreed commission.

They connected me with a seller that I was able to successfully purchase from. Which service did I not get. Having already experiences similar in Germany, this service was entirely expected. Per haps you are too locked into the UK system where the immo is responsible for selling a house on behalf of the seller only an with no obligation to the buyer.

I made an offer on a property today, the document contained this clause that makes it crystal clear that it is the seller that pays the fees albeit via a deduction from the money paid by the buyer.
Si la vente se réalise, le mandataire ayant concouru à la présente offre aura droit aux honoraires prévus au mandat écrit préalablement délivré portant le n° ****** comme cela résulte du registre des mandats, soit : - la somme de sept mille euros TTC ( 7000 € TTC) TVA comprise au taux actuellement en vigueur de 20 %. - ou . % TTC, TVA comprise au taux actuellement en vigueur de 20 %, calculé sur le prix principal de vente mentionné ci- dessus. Cette rémunération sera due par le vendeur , qui l’accepte et sera exigible et versée le jour où l’opération sera effectivement conclue et réitérée par acte authentique.
The only way I could see it being any different is if you had engaged a property search agent who found a property direct with the seller or Notaire.
Come to think of it my current property I bought direct from the liquidator and in the Notaires fees that I paid was a frais de négociation.
Hypothetically were the seller to do a deal directly with me to cut out the agent it would be them sued by the agent and not myself.
