The solidarity day is an additional day of unpaid work for employees. This is carried out every year in order to finance actions in favor of the autonomy of the elderly or disabled. Although it is not a rule, a good part of the companies maintain the solidarity day on Whit Monday.
SOLIDARITY DAY 2021: CHOICE OF DATE
The solidarity day was established by the law of June 30, 2004 relating to solidarity for the autonomy of the elderly and disabled. This day was initially set for Pentecost Monday, until then a public holiday and a day off.
Following the law of April 16, 2008, the system was modified, the default reference to Whit Monday being removed. The solidarity day is now set by establishment agreement or unilaterally by the employer after consulting the social and economic committee ( CSE ). It can be fixed on any day of the year, with the exception of a Sunday or May 1st. Moreover, the solidarity day is not compulsory to take place on the same day for all the company's employees.
However, by tradition, many companies still fix it on Pentecost - June 6, 2022. If this is the case, other methods of fulfilling the day will have to be planned for employees who do not work on Mondays (for example, working on a previously non-working public holiday other than May 1 , working on an RTT day or an additional paid day off).
Attention !
In the departments of Alsace-Moselle, this day cannot be fixed either on Good Friday or on 25 and 26 December.
REMINDER OF THE CONDITIONS OF APPLICATION
The solidarity day consists for the employees of an unpaid additional working day. For employers, it results in a Solidarity Autonomy Contribution of 0.30% on the gross payroll. The sums collected by the State in the name of solidarity are intended to finance actions aimed at strengthening the autonomy of the elderly or disabled.
With regard to the remuneration of employees on that day, it is not modified. Concretely, employees must either perform 7 hours of overtime, or a day of rest or RTT will be deducted from their counter.
