Not as safe as you might think.
I bought and sold a property this week and a neighbour claimed he owned part of the land adjoining his house.
My attestation showed I owned it so asked him to contact the Notaire.
You can ignore the first part its about a customer wanting to use an unregistered UK comapany to translate but I lost to parcels of land.
I could have the sale annuled or asked for a reduction in the price but just leaving it as it is less the two parcels.
Even though the sales contract was completed on Saturday with a simple procuration from the tax office it can be amended.
My buyer is still buying

Le plus souvent, le client fait traduire sa procuration et se rapproche de son propre interprète pour lui faire sa traduction.
Anglo french aident les clients dans la compréhension mais n’ont pas de statuts officiel en France. Par conséquent, lors de la signature d’une procuration ou de l’acte l’avant-contrat et de la vente on ne peut pas se passer d’un traducteur officiel.
S’agissant du bien que vous avez acheté, une erreur a été constaté. Les deux petites parcelles cadastrées section E n°210 et 214 n’appartenaient plus à la succession de Monsieur DARQUET car il l’avait vendu de son vivant.
Nous allons devoir établir un acte rectificatif pour enlever ces parcelles.

Basically the Notaire made a cock up , he/she didn't check that the land had already been sold !

Normally they are very good. The secretary said she did not look at the impôtecare (spelt wrong) paper.
I guess if your getting the paperwork from the tax office they would know what they're selling.

At least I knew what the word is even though my French spelling has the odd error now and again but on the plus side when I post an email from a notaire you know it's genuine 😄 |

When we bought our present gaff & outbuildings, the 3Ha they sat in consisted of about 10 little parcels.
At the meeting for the final signing I checked the numbers of the parcels we were buying & found there were two missing which I mentioned in my dodgy french.
This was quickly remedied by agreement with the kids of the deceased former owner & the contract was signed.

Basically the Notaire made a cock up , he/she didn't check that the land had already been sold ! Normally they are very good. I'm glad that's your experience. It's not mine. |

Most of the time we have had no issues other than lack of contact but if you read on FB it's full of problems with notaires. |

Notaires are not the same as lawyers I know that but treat them both the same - with extreme caution and never trust them to act in your best interests.

1) Those in prison
2) Those waiting to come out of prison
3) Those waiting to go in prison

Ye of so much faith, you haven't heard but some have certainly been known to spend time and for your information, that was told to me by a..............notaire in Provence. He said that was related to both Spain and France and in Spain for a period of time, it was also said about Mayors. Google it, plenty there doing, or having done a stretch. |

Having lived in Spain in two different regions I can say with absolute certainty that the vast majority of the professional class is as bent as a nine bob note, to include alcaldes/mayors - who give contracts to family and old school friends, use banned chemicals, rife throughout Plasticland. After 3 years a bent alcalde can stand for re-election again - How about a totally bent President (USA). Judges who can be bought very easily I know from personal experience and that of two Spanish friends. The judge in my case was later found to have altered a judgement for her boyfriend. Notarios - when selling a house, some of the money appears on the table and some beneath, that's how my friend Jean-Luc sold his house in Rosas, it's totally normal. Houses built on 'rural land' are easily supplied with electricity and water. If buying a house or land from a bank - cuidado,cuidado/be very, very careful. If you are 'enchufargo' everything is possible, if not nothing is possible. If you offer a cheque to a Spaniard they make the sign of the cross and either run away or say no intiendo/I don't understand so it goes.
